These sample policies are provided to assist departments with developing policies for compliance with facility accessibility requirements and are intended to cover:
Staff training and responsibility;
Minimum compliance standard;
Maintaining accessible features;
Stakeholder engagement;
Responding to disability access requests;
Project scoping; and
Accountability.
Because each department has unique operations, procedures for implementing the policies must be established by each department.
All Department staff are responsible for performing their work in compliance with applicable accessible design standards. Staff in the [name of division(s) group(s) directly involved with facility construction, alterations, and/or maintenance] are required to attend training on accessible design standards applicable to their work, as assigned by [supervisor(s)]. Training is required at least [insert sufficient training frequency, based on the nature of work performed].
All accessible features and equipment are maintained on a regular schedule and in compliance with applicable accessible design standards. If any accessible features or equipment are discovered to have become non-compliant, the non-compliance is corrected within 90 days of discovery.
All new construction, additions, and alterations must be performed in compliance with applicable accessible design standards. The Department ADA Liaison (and/or other applicable Department staff) and related stakeholders are engaged in the design and construction phases (0%, 30%, 60%, 90%, and site inspections) to provide feedback on accessibility and usability for people with disabilities. All exceptions to full compliance must be reviewed and approved by [division/position] and documented in the project file. Where multiple departments are involved in the project, the Department will coordinate with all other departments to ensure accessibility compliance is properly scoped in the project.
All Department created design standards/guidelines (including standard plans) and reference tools (such as checklists) are developed in compliance with applicable accessible design standards. Standards/guidelines and reference tools are reviewed annually for any updates necessary to comply with changes to accessible design standards.
Where accessible design standards conflict, the Department applies the standard that provides the greatest accessibility.
Upon request by a person with a disability, the Department will remediate any feature or equipment that does not comply with current accessible design standards, unless an exception is identified that does not require compliance with current standards. Prior to denying a request, the Department will consult with the Department ADA Liaison, the Department on Disability, and/or the Department’s assigned City Attorney. When a request is denied, the requestor is informed of their right to appeal the decision through the City of Los Angeles ADA Title II Grievance Policy & Procedure.
